Troubleshoot tax notice issues because of tax period not filed by Avalara

You may receive a tax notice for the period that was either before or after Avalara started filing return for a jurisdiction. Per Avalara's ToS, Avalara only manages notices for the periods or returns that are filed by Avalara.

Identify the cause of issue

Compare the following values

  • Period listed on the notice
  • Period configured in the scheduled return in Avalara to see if this period falls within the effective dates when Avalara was filing that return.

If the period is before or after the effective dates of the scheduled return, the individual taxpayer is responsible to resolve the issue.

Resolve the issue

To resolve the issue, do the following:

  1. Contact the state to determine what next steps are needed.
    Most likely, you will need to backfile the return and pay the late filing penalty.

  2. Do the backfiling in-house. Alternatively, use the Avalara Professional Services for an additional fee to assist you in backfiling. To avail this service, contact your account manager.
    Note: Avalara backfiling services do not handle paying late file penalties or interest. This amount needs to be paid or abated by the individual taxpayer.

Prevent the issue

To prevent such issues, do the following:

  • Whenever economic nexus is established in a new jurisdiction, have a scheduled return set up immediately in AvaTax.

  • For any help required in setting up the return, you can create support case. at Avalara. However, remember that Avalara support cannot tell you if a return is needed. For help on determination, seek a qualified tax professional.
