Can I resolve a notice from the Department of Revenue myself?

Overview

You want to know if you can resolve a notice received from the Department of Revenue yourself.

Environment

Resolution

  • Yes there are several types of notices you can resolve yourself, even if Avalara is filing your Returns
    • I received a notice for a frequency change (monthly, quarterly, etc..)
      • Create a new filing calendar in Avatax with the new frequency.  Once the new entry is added, the old entry will expire and Compliance will approve your calendar
    • I received a notice from the state or jurisdiction stating they did not receive payment
      • Go to the Avatax > Tax Returns tab > Filing Archive link.  Find your Return - you can print or save a screen shot of the returns form or the Trace ID (either can serve as proof to the Dept of Revenue)
    • I received a notice for a delinquent return
      • Go to Avatax > Tax Returns tab > Filing Archive link to retrieve a copy of the return.  You can submit to the state for resolution
        • If you did not complete a Filing Calendar for Avalara to remit, please go to Tax Returns tab > Filing Calendars  to add the Filing Calendar.  Once completed, contact your Account Manager so that we can backfile.
    • I received a notice for a delinquent payment.  If your funding was late to Avalara, payment may have been submitted to the state/local jurisdiction late as well.  You will need to contact the state to determine the penalty and interest amount that you will need to remit to the state.
      • If you funding was late and Avalara will always remit the return, you will need to contact the state/local jurisdiction to remit the liability and potential penalty/interest.
